Experience
During his final year of law school, Mr. Pembroke was employed by the Firm as a law clerk, his area of concentration within the Firm being public utility law on both a federal and state level, general administrative law and natural resource law. Upon his graduation from law school in May 1975, Mr. Pembroke became formally associated with the Firm and increased his participation in its energy-related activities, in particular, contract negotiations, ratemaking and antitrust matters as related to power generation, transmission, distribution and sale. Mr. Pembroke has participated extensively in bulk power supply planning for municipally and cooperatively owned electric utilities and has participated in the establishment of new consumer owned electric utilities. Additionally, Mr. Pembroke has substantial experience in all aspects of hydroelectric development, including but not limited to, licensing, permitting and related activities. Mr. Pembroke also has substantial experience in utility mergers, territorial integrity issues, municipal condemnation and procedures of utility construction.
Further, Mr. Pembroke is knowledgeable in matters involving the Energy Policy Act of 1992, the Federal Power Act and the Public Utility Regulatory Policies Act (PURPA), particularly as it relates to cogeneration and small power production facilities. In the area of natural resource development, Mr. Pembroke has been involved in litigation, regulatory proceedings and rulemaking proceedings regarding general environmental matters, pollution control and federal coal management. In his general administrative practice, Mr. Pembroke has experience and familiarity with numerous federal and state agencies including the Federal Energy Regulatory Commission, Department of Agriculture, Rural Electrification Administration, General Services Administration, United States Postal Service, Nuclear Regulatory Commission, Federal Communications Commission, Securities and Exchange Commission, Environmental Protection Agency, Federal Election Commission, Department of Energy, Department of Army, United States Corps of Engineers, Louisiana Public Service Commission, Arkansas Public Service Commission, Public Utilities Commission of Texas, New York Public Service Commission, Vermont Public Service Board, Public Service Commission of Indiana, Pennsylvania Department of General Services, the Montana Public Service Commission and others. On February 1, 1980, Mr. Pembroke became an officer of the Firm.
He is the author of an article on developments in constitutional law, 62 Georgetown Law Journal 1771 (July, 1974).
